Wolfe, Commissioner o R D E R WHEREAS the Lieutenant Governor in Council issued Order-in-Council No. 194 February 1, 1982 and directed the Commission to hold hearings on any applications received for a Certificate of Public Convenience and Necessity for the construction and operation of a system of cable undertaking; and WHEREAS the Commission issued a public notice advising of the terms of reference of Order-in-Council No. 194; and WHEREAS Squamish Pay Television Inc. applied for a Certificate of Public Convenience and Necessity by an Application dated August 11, 1982; and WHEREAS the Application was heard by the Commission in Vancouver on August 17, 1982. . .. /2 ~:,E~~'V FIR.ST FLOOP ~i7- WES" hAST!f.. .JGS STPEE"7" vA'\,'CCu .. BRITISH COLUMBIA UTILITIES COMMISSION ORDER NUMBER T-21-82 2 NOW THEREFORE the Commission orders as follows: 1. Subject to satisfactory proof of compliance with the following conditions the Commission will issue a Certificate of Public Convenience and Necessity to Squamish Pay Television Inc. covering the ownership, construction and operation of a system of cable undertaking for the conveyance or transmission of information, messages or communications other than broadcast signals for compensation in the community of Squamish, British Columbia. (a) Prior to commencing construction, Squamish Pay Television Inc. must file with the Commission information on the following: (i) a market survey identifying all potential subscribers in the proposed market area; (ii) an estimate of the capital cost of the proposed facilities including pro-forma ·estimates of profit and loss for the first three years of operation; (iii) evidence of the ability of Squamish Pay Television Inc. to finance the proposal; (iv) a statement of rates to be charged for connection, reconnection and monthly charges for the proposed service in the market area; and (v) an assurance that the proposed system shall be constructed to technical standards equivalent to Part 4 of Department of Communications BP-23 specifications for cable systems. 2. Squamish Pay Television Inc. will own all of the facilities associated with the system of cable undertaking. 3. Squamish Pay.Television Inc. will commence construction and bring the system of cable into operation within a period of six months from the date of the Certificate. . .. /3
4. A complaint which the Commission finds is related to a matter which may be in contravention of the guidelines for enforcement of the obscenity provisions, Criminal Code of Canada may be referred to the Attorney General for investigation and the Commission may suspend the Certificate until such matter is concluded. 5. No variation or alteration of the conditions of this Order may be made without the approval of the Commission first obtained.
