Wolfe, ) Commissioner ) o R D E R WHEREAS the Lieutenant Governor in Council issued Orders-in-Council No. 193 and 194 February 1, 1982 and directed the Commission to hold hearings on any Applications received for a Certificate of Public Convenience and Necessity for the construction or operation of a pay-television undertaking under the authority of Order-in-Council No. 193 or the ownership and operation of a system of cable undertaking under the authority of Order-in-Council No. 194; and WHEREAS the Commission issued a public notice advising of the terms of reference of Orders-in-Council No. 193 and 194~ and WHEREAS Western Pacific Hotels Ltd. applied on behalf of The Denman Hotel for Certificates of Public Convenience and Necessity by Applications dated August 21, 1984; and WHEREAS the Applications were heard by the Commission in Vancouver on October 10, 1984. . .. /2 TWENTY FIRST FLOOR 1177 WEST HASTINGS STREET VA"<OOuVER B V6E 2L; CANADA TELEPHONE '604 669-1831 TELEX O"-~4536
NOW THEREFORE the Commission orders as follows: 1. Certificate of Public Convenience and Necessity No. T-52-84 issue to The Denman Hotel covering the ownership and operation of a pay-television undertaking, not including broadcasting or the distribution of broadcast signals, serving The Denman Hotel, 1733 Comox Street, Vancouver, British Columbia, all as more particularly described in the Application and hearing record, subject to the terms of service described in the Application and the hearing record. 2. Certificate of Public Convenience and Necessity No. T-52-84 issue to The Denman Hotel covering the ownership and operation of a system of cable undertaking serving the pay-television undertaking at The Denman Hotel, 1733 Comox Street, Vancouver, British Columbia, all as more particularly described in the Application and hearing record. 3. A complaint which the Commission finds is related to a matter which may be in contravention of the guidelines for enforcement of the obscenity provisions, Criminal Code of Canada may be referred to the Attorney General for investigation and the Commission may suspend the Certificates until such matter is concluded. 4. No variation or alteration in the Certificates of Public Convenience and Necessity or this Order may be made without the approval of the Commission first obtained.
