BEFORE: R.J. Ludgate, Chairman, Division of of the Commission and, August 29, 1984 Commissioner~ and W. Wolfe, Commissioner o R D E R WHEREAS the Lieutenant Governor in Council issued Order-in-Council No. 194 February 1, 1982 and directed the Commission to hold hearings on any Applications received for a Certificate of Public Convenience and Necessity for the construction and operation of a system of cable undertaking; and WHEREAS the Commission issued a public notice advising of the terms of reference of Order-in-Council No. 194; and WHEREAS Mustang Communications Inc. applied for a Certificate of Public Convenience and Necessity by an Application dated January 19, 1984: and WHEREAS the Applications were heard by the Commission in Vancouver on January 30, 1984; and WHEREAS the Applicant submitted a Business Plan which was considered on August 17, 1984, following which amended Applications pertaining to Cable Service Undertakings at 13 locations in the Greater Vancouver area were submitted to the Commission on August 27, 1984. . .. /2 -.',f",,-' r- ::::::- .. ;:~o::: .~ ... - ',",E::'" ""''''::: .. ~.G~ S .... ;:;;EE ... t.·,,::: .. ·.. NOW THEREFORE the Commission orders as follows: 1. Certificate of Public Convenience and Necessity No. T-34-84 issue to Mustang Communications Inc. covering the ownership, construction and operation of a system of cable undertaking for the conveyance or transmission of information, messages or communications, not including broadcasting or the distribution of broadcast signals, serving the Corporation of the District of Delta, British Columbia, all as more particularly described in the Application and hearing record, subject to the terms of service described in the Application and hearing record, and in the Business Plan submitted August "17, 1984. 2. A complaint which the Commission finds is related to a matter which may be in contravention of the guidelines for enforcement of the obscenity provisions, Criminal Code of Canada may be referred to the Attorney General for investigation and the Commission may suspend the Certificates until such matter is concluded. 3. No variation or alteration in the Certificates of Public Convenience and Necessity or this Order may be made without the approval of the Commission first obtained.
