Wolfe, ) November 15, 1985 Commissioner ) o R D E R WHEREAS the Lieutenant Governor in Council issued Orders-in-Council No. 193 and 194 February 1, 1982 and directed the Commission to hold hearings on any Applications received for a Certificate of Public Convenience and Necessity for the construction or operation of a pay-television undertaking under the authority of Order-in-Council No. 193 or the ownership and operation of a system of cable undertaking under the authority of Order-in-Council No. 194; and WHEREAS the Commission issued a public notice advising of the terms of reference of Orders-in-Council No. 193 and 194: and WHEREAS Nuxa1k T.V. BRITISH COLUMBiA UTILITIES COMMISSlOtl 2 ORDER NUMBER. T-16-85 NOW THEREFORE the Commission orders as follows: 1. Certificate of Public Convenience and Necessity No. T-16-85 issue to Nuxalk T.V. Society covering the ownership and operation of a pay-television undertaking, not including broadcasting or the distribution of broadcast signals, serving Bella Coola and Four Mile subdivision, British Columbia, all as more particularly described in the Application and hearing record, subject to the terms of service described in the Application and the hearing record. 2. Certificate of Public Convenience and Necessity No. T-16-85 issue to Nuxalk T.V. Society covering the ownership and operation of a system of cable undertaking serving the pay-television undertaking at Bella Coola and Four Mile subdivision, British Columbia, all as more particularly described in the Application and hearing record. 3. The system of cable must be constructed to technical standards equivalent to Part 4 of Department of Communications BP-23 for cable systems. 4. Nuxalk T.V. Society will place any funds received as deposits or advances by applicants for the service into a trust account with a chartered bank which funds will be refundable with bank interest until service has been provided to the applicant. 5. A complaint which the Commission finds is related to a matter which may be in contravention of the guidelines for enforcement of the obscenity provisions, Criminal Code of Canada may be referred to the Attorney General for investigation and the Commission may suspend the Certificates until such matter is concluded. 6. No variation or alteration in the Certificates of Public Convenience and Necessity or this Order may be made without the approval of the Commission first obtained.
