Wolfe, ) Commissioner ) o R D E R WHEREAS the Lieutenant Governor in Council issued Orders-in-Council No. 193 and 194 dated February 1, 1982, the intent of which was to encourage competition; the orderly introduction of new technology; diversity of programming services: and which directed the Commission to hold hearings on any Applications received for Certificates of Public Convenience and Necessity for the construction and operation of an enterprise or a facility as enunciated and described within the above-mentioned Orders-in-Council; and WHEREAS the Commission issued a public notice advising of terms of reference of Orders-in-Council No. 193 and 194; and WHEREAS Geocrete Structural Systems Incorporated ("Geocrete") applied August 7, for a Certificate of Public Convenience and Necessity authorizing the construction and operation of a coaxial cable distribution network in Greater Victoria, B.C. the non-broadcast facilities of which will be available for leasing to others duly authorized to provide program, signal and data services; and .../ 2
B~nISH COLUMBIA UTlUTIES COMMISSION 2 ORDER NUMBER _T_-_l_l_-_8_6 __ WHEREAS the Commission has considered the Application by Geocrete and the evidence adduced during the course of a hearing which occurred in Vancouver on September 12, 1986. NOW THEREFORE the Commission orders as follows: 1. Certificate of Public Convenience and Necessity will be issued to Geocrete Structural Systems Incorporated covering the ownership and operation of a system of cable undertaking for the carriage of non-broadcast as specified in the Application upon Geocrete satisfying the following conditions: (a) A Tariff containing Rate Schedules, Terms and Conditions of Service, Agreements and Contracts pertaining to the services to be provided by Geocrete is to be filed with the Commission. (b) All prepaid amounts or security deposits or advances received by Geocrete from applicants for service are to be held in a trust account with a chartered bank. Such amounts v,;ill be refundable with bank interest until service has been provided to the applicant. (c) Quarterly progress reports are to be filed with the Commission during the first year of operation, and annually thereafter. (d) Geocrete will complete construction and commence operation of the said system of cable undertaking prior to June 1, 1987. (e) Geocrete undertakes to meet or exceed technical standards equivalent to Part 4 of the Department of Com munications BP-23 for cable systems, as applicable. 2. A complaint which the Commission finds is related to a matter which may be in contravention of the guidelines for enforcement of the obscenity provisions, Criminal Code of Canada may be referred to the Attorney General for investigation and the Commission may suspend the Certificate until such matter is concluded. 3. No variation or alteration to this Order may be made \vithout the approval of the Commission first obtained.
