Wolfe, ) Commissioner ) o R D E R WHEREAS the Lieutenant Governor in Council issued Order-in-Council No. 193 and 194 dated February 1, 1982, the intent of which was to encourage competition; the orderly introduction of new technology; diversity of programming services; and which directed the Commission to hold hearings on any Applications received for Certificates of Public Convenience and Necessity for the construction and operation of an enterprise or a facility as enunciated and described within the above-mentioned Orders-in-Council; and WHEREAS the Commission issued a public notice advising of the terms of reference of Order-in-Council No. 193 and 194; and WHEREAS LDAC Long Distance Access Corp. ("LDAC") applied for Certificates of Public Convenience and Necessity by an Application dated August 1, 1985; and WHEREAS the Application was heard by the Commission in Vancouver on September 27, 1985. . .. /2 FOURTH FLOOR 800 SMITHE STREET. BRITISH COLUMBIA UTILITIES COMMISSION 2 ORDER NUMBER T-17-85 NOW THEREFORE the Commission orders as follows: 1. Certificates of Public Convenience and Necessity will be issued to LDAC Long Distance Access Corp. covering the ownership, construction and operation of facilities described by LDAC to be operated within the Province of British Columbia only, all as more particularly described in the Application and hearing record, upon LDAC Long Distance Corp. satisfying the following conditions: (a) A Tariff containing Rate Schedules, Terms and Conditions of Service, Agreements and Contracts pertaining to the services to be provided by LDAC is to be filed with the Commission. (b) All prepaid amounts or security deposits or advances received by LDAC from applicants for service are to be held in a trust account with a chartered bank. Such amounts will be refundable with bank interest until service has been provided to the applicant. (c) Quarterly progress reports are to be filed with the Commission during the first year of opertion, and annually thereafter. (d) LDAC will complete construction and commence operation of the said system of cable undertaking prior to October 1, 1986. (e) LDAC undertakes to meet or exceed technical standards of the Department of Communications. 2. A complaint which the Commission finds is related to a matter which may be in contravention of the guidelines for enforcement of the obscenity provisions, Criminal Code of Canada may be referred to the Attorney General for investigation and the Commission may suspend the Certificates until such matter is concluded. 3. No variation or alteration to this Order may be made without the approval of the Commission first obtained.
