Martin, Commissioner o R D E R WHEREAS on January 3D, 1987 Hemlock Valley Electrical Services Ltd. (tlHemlock Electrical") applied to the Commission pu'r suant to Section 61 of the ut i 1 i ties Commiss ion Act ("the Act tI ) for approval of the Commission to register on its books the transfer of all shares of Hemlock Valley Electrical Services Ltd. from Hemlock valley Recreations Limited to Hemlock Valley Resorts Inc.; and WHEREAS on January 3D, 1987 Hemlock Valley Resorts Inc. ("Hemlock Resor ts") appl ied to the Commiss ion pu r suant to Section 61 of the Act for approval of the acquisition by Hemlock Valley Resorts Ltd. of 29,710 shares of Hemlock Electrical; and WHEREAS Section 61(8) of the Utilities Commission Act (lithe Act") states: "The commission may give its approval under this section subject to conditions and requirements it considers necessary or desirable in the public interest, but the commission shall not give its approval under this section unless it considers that the public utility and the users of the service of the public utility will not be detrimentally affected." ... /2
2 ORDER NUMBER G-18-87 WHEREAS the Commission concludes that general and public interest require that the Applications be heard in an informal public forum. NOW THEREFORE the Commission orders: 1. That the Applications of Hemlock Valley Electrical Services Ltd. and Hemlock Valley Resorts Inc. be set for hearing commencing at 9:30 a.m. local time on Tuesday, June 9, 1987 at the Commission Hearing Room located on the Fourth Floor, 800 Smithe Street, Vancouver, B.C. 2. That the Commission Secretary arrange for distribution of the Notice of Hearing to all customers of the utility. 3. That Hemlock Electrical and Hemlock Resorts file with the Commission on or before Wednesday, June 3, 1987 any additional or amended material upon which they intend to rely. 4. That any interested party intending to be present and participate in the public hearing and who may intend to present a written submission pertaining to this matter should provide one copy each to the Commission Secretary, and to Hemlock Electrical and Hemlock Resorts (Box 7, Site No.2, R.R. #1, Agassiz, B.C., VOM lAO) not later than Wednesday, June 3, 1987. THE APPLICATIONS Hemlock Valley Electr ical Services Ltd. (IIHemlock Electr ical") , an electric utility company providing electricity for the recreational and ski facilities on Hemlock Mountain, and Hemlock Valley Resorts Inc. ("Hemlock Resorts ll ) have applied to the British Columbia Utilities Commission (lithe Commission") pursuant to Section 61 of the utilities Commission Act ("the Act"), for Commission approval of the acquisition by Hemlock Resorts of 29,710 shares of Hemlock Electrical and to the transfer thereof on the books of Hemlock Electrical. THE PUBLIC HEARING The Commission has ordered that the Applications of Hemlock Electrical and Hemlock Resorts Inc. be heard commencing at 9:30 a.m. local time, on Wednesday, June 9, 1987 at the Commission Hearing Room located on the Fourth Floor, 800 Smithe Street, Vancouver, B.C. Section 61(8) of the Act states: "The commission may give its approval under this section subject to conditions and requirements it considers necessary or desirable in the public interest, but the commission shall not give its approval under this section unless it considers that the public utility and the users of the service of the public utility will not be detrimentally affected." The Commission invites customers of Hemlock Electrical to attend. WRITTEN SUBMISSIONS Interested parties intending to present a written submission pertaining to this matter should provide one copy each to the Commission Secretary, and to Hemlock Electrical and Hemlock Resorts (Box 7, Site No.2, R.R. #1, Agassiz, B.C., VOM lAO) not later than Wednesday, June 3, 1987.
