BRITISH COLUMBIA UTILITIES COMMISSION ORDER NUMBER _G_-_l_9_-_8_6_ _ PROVINCE OF BRITISH COLUMBIA BRITISH COLUMBIA UTILITIES COMMISSION IN THE MATTER OF the utilities Commission Act, S.B.C. 1980, c. 60, as amended and IN THE MATTER OF Matters in Dispute between West Kootenay Power and Light Company, Limited ("WKPL") and British Columbia Hydro and Power Authority ("B.C. Hydro") BEFORE: M. Taylor, Chairman; J.D.V. Newlands, Deputy Chairman; D.B. Kilpatrick, April 4, 1986 Commissioner; and N. Martin, Commissioner o R D E R WHEREAS pursuant to submissions by WKPL and B.C. Hydro in November, 1985 pertaining to the supply of electric power and the wheeling thereof by B.C. Hydro to WKPL a public hearing was ordered, to commence at Vancouver, B.C. on December 11, 1985; and WHEREAS on November 26, 1985 B.C. Hydro applied for an adjournment of the hearing, and that Application was heard before the Commission as a preliminary matter on December 11, 1985; and WHEREAS on December 11, 1985 WKPL made clear that it was willing to proceed with respect to all of the Issues; while B.C. Hydro indicated that its counsel was unable to prepare filed testimony, document requests or interrogatories; and WHEREAS on December 18, 1985 the Commission issued a Decision which adjourned the December 11, 1985 proceeding to April 8, 1986, and established various procedural requirements to be met including a February 14, 1986 filing date for written evidence: and ... /2 FOURTH FLOOR, 800 SMITHE ST8EET VA'JCOUVE8 B C V5Z 2£' CA'iA::;;t., TEcEPHO'\E 16041660-4700 TELEX 04-54536

Hydro filed extensive additional evidence, identified as Volume 1 (Part 2), Supplementary Prepared Testimony; and WHEREAS on April 1, 1986 counsel for WKPL made a written submission requesting that the expert testimony of Allan J. Schultz, found in B.C. Hydro's Volume 1 (Part II) filing be ruled inadmissable since it violated the February 14, 1986 filing date contained in the Commission's December 18, 1985 Decision; and WHEREAS counsel for WKPL further declared that it will be either impossible or extremely difficult to prepare in time any rebuttal evidence which may be called for by the Schultz report; and WHEREAS the Commission believes that this additional evidence is pertinent to the proceedings and that an adjournment of the April 8, 1986 public hearing is necessary to permit adequate consideration of that new evidence. NOW THEREFORE the Commission orders that the April 8, 1986 hearing be adjourned and rescheduled as follows: 1. From Monday, May 12, 1986 through Friday, May 16, 1986 at The Park Lake Motor Inn, 1600 Abbott Street, Ke1owna, B.C. commencing on Monday, at 9:30 a.m. local time. 2. From Wednesday, May 21, 1986 through Friday, May 23, 1986 at The Sandman Inn, 1944 Columbia Avenue, Cast1egar, B.C. commencing on Wednesday at 9:30 a.m. 3. Any additional evidence of WKPL or any Intervenor must be filed not later than Thursday, May 1, 1986.
