BEFORE: J.D. V. Newlands, Deputy Chairman; and N. Martin, Commissioner o R D E R WHEREAS amendments to the Utilities Commission Act (lithe Act"), including Section 85.3, require ("Contracts") between producers and consumers, be filed with the Commission for approval; and WHEREAS West Kootenay Power Ltd. ("WKP") filed with the Commission by letter dated May 15, 1990 a fully executed Contract with Cascade Pacific Power Corporation ("CPPC") covering a ten year period commencing on or before December 15, 1990, for electric power and energy generated at CPPC's hydro-electric generating plant located on the Goat River, near Creston, B.C.; and WHEREAS CPPC has applied to the Minister of Energy, Mines and Petroleum Resources for an Exemption from Section 27 of the Act consistent with Ministerial Order M5l, the approval of which is pending; and WHEREAS the Commission including technical requirements and rates and is satisfied that it is in the public interest. NOW THEREFORE pursuant to Section 85.3 of the Act the Commission hereby orders as follows: 1. The Commission approves and accepts for filing the Contract between West Cascade Pacific Power Corporation which is designated as Energy Supply Contract, ESC No.3.
