Swanson, Q.C., ) Commissioner ) o R D E R WHEREAS on December 20, 1988, Canadian Pacific Limited ("CP") applied to the British Columbia Utilities Commission (lithe Commission") for exemption from the provisions of the Utilities Commission Act (lithe Act"), other than Part 2; and WHEREAS CP entered into an agreement with Cona Holdings Ltd. ("Cona") dated November 28, 1988 ("the Agreement") covering the sale of power from the CP owned powerline near Revelstoke, B.C. to Cona's resort at Albert Canyon, B.C.; and WHEREAS the Commission has considered the application and is satisfied that an order exempting CP from certain sections of the Act properly conserves the public convenience and interest; and WHEREAS the Commission may, pursuant to section 114 of the Act, reconsider, vary or rescind an order made by it. NOW THEREFORE pursuant to its powers under Section 103(3) of the Act the Commission orders as follows: 1. The sale of power between CP and Cona pursuant to the Agreement be exempt from the Act other than Section 114 and Part 2. 2. This Exemption Order shall not have force and effect until after the date upon which it is approved by the Lieutenant Governor in Council, pursuant to Section 103(3) of the Act.
