s ~ (",. ; . ;~ Scot-/! \'t' PROVINCE OF BRITISH COLUMBIA BRITISH COLUMBIA UTILITIES COMMISSION IN THE MATTER OF the Utilities Commission Act, S.B.C. 1980, c. 60, as amended and IN THE MATTER OF a Complaint by Petro-Canada Inc. and a Complaint by Coast Pacific Management Inc. BEFORE: J.D. V. Newlands, Deputy Chairman; and N. Martin, Commissioner o R D E R WHEREAS Petro-Canada Inc. ("PCP') by letter dated June 2, 1989, complained to the Commission over the refusal of BC Gas Inc. ("BC Gas") to accept and sign an exclusivity waiver to permit PCI to "drop-off" gas a t the BC Gas/Westcoast Energy Inc. ("WEI") interconnect near PCPs Port Moody refinery in respect of their upstream service agreement with WEI; and WHEREAS the Commission requested and BC Gas responded to the PCI complaint by letter dated July 5, 1989; and WHEREAS PCI advised the Commission that resolution of the complaint was not possible based on proposals made by BC Gas; and WHEREAS Coast Pacific Management Inc. (ffCPM dated July 25, 1989, complained to the Commission respecting Transportation Service for B.C. Sugar Refining Co. Ltd. and Chatterton Petrochemical Corpora tion. NOW THEREFORE by virtue of the powers of inquiry pursuant to Section 93(2) of the Utilities Commission Act and the concurrence of the Lieutenant-Governor in Council, the Commission hereby orders as follows: 1. Mr. W.J. Grant, Director of Engineering and Accounting, is directed to conduct an inquiry into the PCI and CPM complaints. 2. The Commission directs that the report be available for review and consideration October 2, 1989.
