Martin, ) Commissioner ) CER TIFICA TE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS British Columbia Hydro and Power Authority (''B.C. Hydro") applied for an Energy Project Certificate pursuant to Section 18 of the Utilities Commission Act ("the Act") by Application dated September 15, 1989, to construct and operate a new 500 kV Transmission Line from Williston Substation to Kelly Lake Substation in conformity with the requirements of British Columbia Regulation 388/80; and WHEREAS the Minister of Energy, Mines and Petroleum Resources and other interested government agencies reviewed the Application and reports submitted in support of the Application; and WHEREAS the Minister ordered that pursuant to Section 19(1)(b) of the Act, that the Application be dealt with by the British Columbia Utilities Commission (lithe Commission") under Part 3 of the Act, as an Application for a Certificate of Public Convenience and Necessity; and WHEREAS the Minister conveyed the Application and a Summary of Agency Comments and Requests for Additional Information dated December 15, 1989 to the Commission; and โ€ขโ€ขโ€ข/ 2 SIXTH FLOOR, 900 HOWE STREET. BRITISH COLUMBIA UTILITIES COMMISSrON ORDER NUMBER C-1-90 2 WHEREAS the Commission has determined that the public interest and necessity requires one additional 500 kV transmission line between Williston Substation and Kelly Lake Substation; and WHEREAS B.C. Hydro has a number of outstanding requirements related to social, environmental and other matters which will affect the routing of the line and construction practices in certain localized areas; and WHEREAS the Commission believes that line routing and other identified social and environmental concerns are confined to only small segments of the line. NOW THEREFORE the Commission hereby orders B.C. Hydro as follows: 1. A Certificate of Public Convenience and Necessity is granted to B.C. Hydro for the construction and operation of a 500 kV transmission line between Williston Substation and Kelly Lake Substation estimated to cost approximately $178 million. 2. B.C. Hydro is not to initiate construction on the transmission line before B.C. Hydro has met the various requirements provided on the attached Appendix to this Order. In this regard, B.C. Hydro must satisfy the Commission of such compliance. 3. Once B.C. Hydro is given leave to start construction on the transmission line, it is to proceed expeditiously with all necessary arrangements pertaining to the acquisition and placement into active service of the attendant facilities. 4. B.C. Hydro is required to file monthly Construction Progress Reports, in addition to detailing the bidding, awarding of contracts, and capital cost expectations as the project progresses. APPENDIX WILLISTON - KELLY LAKE .500kV TRANSMISSION LINE Construction and operation of this project may proceed, subject to the following conditions: I. B.C. Hydro, its servants and its agents, shall comply with all applicable orders and conditions, and shall obtain and comply with all applicable licences, permits, approvals, tenures and standards which may include or result from the following: a) licences, permits and approvals pursuant to the Water Act, Health Act and Heritage Conservation Act. b) approvals pursuant to the Land Act for access roads and other land use invol ving crown lands outside the right-of-way. c) approvals from the Agricultural Land Commission for right-of-way widening on lands designated as Agricultural Land Reserve. 2. B.C. Hydro shall be guided in its location, design and construction of the project in accordance with the directives and information requirements contained in the "Summary of Agency Comments and Requests for Additional Information" sent under cover of D.H. Horswill's letter to C.W.J. Boatman dated December 18, 1989. 3. B.C. Hydro shall be subject to further direction from the Commission on any matter arising pursuant to B.C. Hydro's Public Consultation Report and Environmental Impact Assessment Report on this project. 521/24
