Swanson, Q.C., ) Commissioner ) R WHEREAS on June 21, 1990, Canadian Pacific Forest Products Limited (HCPFP") applied to the British Columbia Utilities Commission (lithe Commission") for exemption from the provisions of the Utilities Commission Act (lithe Act"), other than Part 2, in respect of the resale of electricity by CPFP to Gold River Newsprint Limited Partnership; and WHEREAS B.C. tlydro and Power Au thority provided CPFP with written perrnission dated August 2, 1990 covering the resale of power frorn CPFP's pulp mill at Gold River, B.C. to the adjacent newsprint facility; and WHEREAS tile pulp mill and newsprint mill share a number of utility services including the use of steam generated by CPFP's pulp mill; and WHEREAS the Commission has considered the application and is satisfied that an order exempting CPFP froll) certain sections of the Act properly conserves the public convenience and interest; alld WHEREAS the Commission may, pursuant to Section 114 of the Act, reconsider, vary or rescind an order made by it. NOW THEREFORE pursuant to its powers under Section 103(3) of the Act the Commission orders as follows: l. The sale of power between CPFP's pulp mill and the Gold River Newsprint Limited Partnership newsprint facility be exempt from the Act 0 ther than Section 114 and Part 2. 2. This Exemption Order shall not have force and effect until after the date upon which it is approved by the Lieutenant Governor in Council, pursuant to Section 103(3) of the Act.
