BEFORE: J.G. McIntyre, Chairman; J.D.V. Newlands, Deputy Chairman; N. Martin, Commissioner; and W.M. Swanson, Q.C., Commissioner WHEREAS West Kootenay Power Ltd. ("WKP") applied on February 20, 1990 for a one-year extension to certain dates contained Sections 7.02 and 7.03 of its Power Purchase Agreement with B.C. Hydro and Power Authority (IIB.C. Hydro") dated October 15, 1986 (lithe Agreement"); and WHEREAS the Commission, by issuing Order No. G-14-90, contemplated that a reasonable extension of time for nominations, including transi tion dates covered in the Agreement, would be in the best interests of both parties; and WHEREAS B.C. Hydro, by letter dated March 2, 1990, agreed that changes to the Agreement should be made to accommodate the transition period covered by Sections 8.0 I and 8.02; and WHEREAS the Commission has reviewed and considered the requested changes in the Agreement and is satisfied that they are in the public interest. NOW THEREFORE the Commission orders as follows: I. The Commission approves a one-year extension of the nomination period provided in Section 7 of the Agreement: (a) Section 7.02 is to be titled "Nominations Made Prior to 1991" and the reference in the second I ine of the paragraph "to 1990" should be changed "to 1991 ". The Commission will accept, subject to timely filing, an executed copy of the amendments to the Agreement as confirmed by the Order.
