BRITISH COLUMBIA UTILITIES COMMISSION IN THE MATTER OF the Utlllties Commission Act, S.B.C. 1980, c. 60, as amended and IN THE MATTER OF an Application by Pacific Northern Gas Ltd. BEFORE: J.G. McIntyre, Chairman; J.D. V. Newlands, Deputy Chairman; N. Martin, Commissioner; and W.M. Swanson, Q.C., Commissioner CER TIFICA TE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS on May 15, 1990 Pacific Northern Gas Ltd. ("PNG") applied for approval of a franchise agreement dated August 13, 1988 (lithe Agreement") between PNG and The Corporation of the Village of Burns Lake ("the Municipality"); and WHEREAS the Agreement replaces an Order of the Public Utilities Commission dated August 13, 1968 which set forth the terms and conditions under which PNG could enter upon and use public thoroughfares and places within the Municipality for Its operations; and WHEREAS the Municipality has obtained approval in principle of the Agreement from the Ministry of Municipal Affairs, Recreation and Culture; and WHEREAS the Commission has reviewed the Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Utilities Commission Act, the Commission approves the Agreement between PNG and The Corporation of the Village of Burns Lake which shall expire 21 years from the effective date of this Order, provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
