Page, ) Commissioner ) o R D E R WHEREAS on November 30, 1989, pursuant to Section 67 of the Utilities Commission Act ("the Act"), West Kootenay Power Ltd. ("WKPII) applied for a Commission Order granting a rate increase of 6.9% applicable uniformly to all classes of service, effective with consumption on and after January 1, 199~and WHEREAS Commission Order No. G-67 -89 approved a 6.9% interim increase effective January 1, 1990, subject to refund with interest calculated at the average prime rate of the principal bank with which WKP conducts its business; and WHEREAS Commission Order No. G-15-90 set down the WKP Application for public hearing to commence April 3, 1990 in Rossland, B.C.; and WHEREAS on March 26, 1990 WKP requested a postponement of the public hearing into its Application which was subsequently granted by Commission Order No. G-24-90; and WHEREAS Commission Order No. G-47-90 approved WKP's May 28, 1990 Application for a refund of 1.4% inclusive of interest, thereby reducing the interim increase to 5.5%, as a result of the availability of power purchases from Cominco Ltd. and other cost reductions; and WHEREAS on September 7, 1990 WKP filed evidence in support of its Rate Application that included its current 1990 fiscal year and forward test years of 1991 and 1992; and WHEREAS the Commission has reviewed the Application and supporting documentation and requires the matter to be set down for public hearing. NOW THEREFORE the Commission orders WKP as follows: I. WKP will arrange for publication in display ad format, not later than Thursday, September 20, 1990, of a Notice of Public Hearing, as per attached copy, in the Vancouver Sun, The Province and such other appropriate local news publications as may properly provide adequate Notice to the population in the service area of the utility. 3. The Applica tion and supporting material is to be made available for inspection at the Head Office of West Kootenay Power Ltd., Waneta Plaza, 8100 Rock Island Highway, Box 130, Trail, B.C., VI R 4L4; and at its District Offices located at Castlegar, Crawford Bay. Intervenors and Interested Persons intending to be present and participate in the pubUc hearing should give written Notice of intention to do so to the Commission Secretary and to the Applicant, to be received not later than Monday, October l, 1990. Application to Increase Rates and Amend its Tariff NOTICE OF PUBLIC HEARING Time: 9:00 a.m. Date: October 22, 1990 Location: Uplander Hotel 1919 Columbia Avenue Rossland, B.C. THE APPLICATION West Kootenay Power Ltd. (IIWKPII) is applying to confirm the existing interim increase of 5.5% and have applied for further increases of 5.6% and 4.9% effective January 1,1991 and January 1,1992. The Company has submitted that these increases are necessary to recover its increase in power purchases costs and wheeling, plant investment and operating and maintenance costs and to provide its shareholders with a return on equity of 13.68%, 13.75% and 13.75% respectively for each year. The Commission will also hear submissions with regard to: 1. Increasing charges for service, disconnection/reconnection, relocation and returned-cheque charges. 2. Municipal Customers' Participation in Power Sense Program. THE PUBLIC HEARING The Application will be heard commencing at 9:00 a.m. local time, Monday, October 22, 1990 at the Uplander Hotel, 1919 Columbia A venue, Rossland, B.C.
