IN THE MAT IER OF the Utilities Commission Act, S.B.e. 1980, c. 60, as amended and IN THE MA TIER OF an Application by Westcoast Power Inc. and Canadian Utilities Limited BEFORE: J.G. McIntyre, ) Chairman; ) J.D.V. Newlands, ) Deputy Chairman; ) May 16, 1991 N. Martin, ) Commissioner; and ) W.M. Swanson, Q.C., ) Commissioner ) o R D E R WHEREAS: A. Amendments to the Utilities Commission Act (lithe Act"), including Section 85.3, require that Energy Supply Contracts ("Contracts") between producers and consumers be filed with the Commission for approval; and B. On May 10, 1991 Westcoast Power Inc. and CU Power, a division of Canadian Utilities Limited, jointly referred to as (lfWescup") filed with the Commission natural gas supply contracts with Westcoast Petroleum Ltd. and Northwest Pacific Energy Marketing Inc. covering the supply of gas to the McMahon Generation Plant at Taylor, B.C.; and C. The Commission has reviewed the natural gas supply contracts and supporting material and is satisfied that approval is necessary and in the public interest. NOW THEREFORE the Commission hereby orders as follows: 1. The Gas Sales Agreement between Northwest Pacific Energy Marketing Inc. and Wescup dated November 9, 1990 for the supply of 350 10 3 m 3 of gas per day to the Plant for a period of 21 years is approved pursuant to the Rules and the Act. 2. The Gas Purchase Agreement between Westcoast Petroleum Ltd. and Wescup dated December 10, 1990 for the supply of 175 10 3 m 3 of gas per day to the Plant for a period of 21 years is approved pursuant to the Rules and the Act.
