Hall, Commissioner o WHEREAS on November 30, 1989, pursuant to Section 67 of the Utilities Commission Act (lithe Act"), West Kootenay Power Ltd. (flWKPII) applied for a Commission Order granting a rate increase of 6.9 percent applicable uniformly to all classes of service, effective with consumption on and after January I, 1990: and WHEREAS Comrnission 6.9 percent interim increase effective January I, 1990, subject to refund with interest calcula ted at the average prime ra te of the principal bank wi th which WK P conduc ts its business; and WHEREAS Commission Order No. G-15-90 set down the WKP Appiica tion for public hearing to commence April 3, 1990 in Rossland, B.C.; and WHEREAS on March 26, 1990, as a result of a labour dispute with its workers, WKP requested a postponement to the public hearing into its Application which was subsequently No. G-24-90; and WHEREAS WK P applied on May 28, 1990 to refund a portion of the interim illcrease approved by Order No. G-67-89 as a result of the a vailabili ty of power purchases from Cominco Ltd. and other cost reductions; and WHEREAS the Commission has considered the WK P request and finds that a partial refund of the interim increase is necessary and in the public interest. fH r, ()('1D a()n Ur')IAlC c> t nr-r*T ,fA" ,,",""'" ",..-~, ." ....... r BflrnSa COLUMBiA' "'7($'.1 ;,; UTlllll,S COMMiSSION 11 ' ~! ~ J, ~ " ? BRln~U COLUMBIA UTlllllES COMM~SSION 2 ORDER NUMBER G-47-90 NOW THEREFORE the Commission orders as follows: 1. The Commission approves a reduction of the interim rate from 6.9 percent to 5.5 percent effective immediately. The revised interim rate of 5.5 percent is effective from January I, 1990 with such interim increase to be subject to refund with interest calculated at the average prime rate of the principal bank with which WKP conducts its business. 2. WKP will refund the portion of the interim increase collected in excess of 5.5 percent, with interest, at the average prime rate of the Company's principal bank, from January I, 1990 to the date of the refund. 3. WKP will file an amended Application to include revenue requirements inforrnation for the 1991 test year on or before September 15, 1990 along with such other financial information that may be pertinent to the proceedings. 4. The establishment of the public hearing date will be the subject of a further Order of the Commission anticipated to be issued in September, 1990 following WKP's filing of revenue requirements information. 5. The Commission w11l accept, subject to timely filing, Electric Tariff Rate Schedules amended in accordance with the Application and terms of this Order.
