Jaccard, ) Chair; and ) October 8, 1992 L.R. Barr, ) Deputy Chair ) o R D E R WHEREAS: A. On September 8, 1992 British Columbia Hydro and Power Authority ("B.C. Hydro") applied by Letter of Application for a Certificate of Public Convenience and Necessity ("CPCN"), pursuant to Section 51(3) of the Utilities Commission Act ("the Act"), to remove Circuit 1L14 from Canadian National Railways' ("CN"), lands in the Songhees area of Victoria and to construct and operate an alternative 138 kV supply from the Pike Lake Substation to the Goward Substation, a distance of approximately 1.9 km; and B. The original right-of-way agreement executed in the 1940's between CN and B.C. Electric, predecessor to B.C. Hydro, allowed CN to give 30 days' notice for B.C. Hydro to vacate the property. The removal of the 138 kV line will facilitate a planned commercial and residential waterfront property development; and C. Whereas the new 138 kV line will be constructed on the vacant side of existing double circuit towers carrying an existing circuit. D. Correspondence submitted with the Application indicates that a number of alternatives were considered, an environmental impact assessment had been completed, and that the route selected was the least expensive and the only solution that could be implemented within the required time frame. E. The Commission has reviewed the Application and has determined that the removal of Circuit 1L14 from CN lands and the construction of the proposed 1.9 km, 138 kV transmission line is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE the Commission orders as follows: 1. A CPCN is granted to B.C. Hydro to construct and operate a 138 kV transmission line from the Pike Lake Substation to the Goward Substation in Victoria, a distance of approximately 1.9 km. 2. B.C. Hydro is authorized to remove circuit 1L14 from the CN lands in the Songhees area of Victoria. 3. This CPCN is subject to the following conditions: (i) B.C. Hydro, its agents and contractors shall comply with all applicable orders and conditions and shall obtain and comply with all applicable licences, permits, approvals, tenures, regulations and standards. . . ./2 c c

Hydro is to provide the Commission with a copy of the infonnation package sent to affected property owners and to provide the Commission with a detailed summary of all public enquiries or complaints about the project received up to time of energization. (iii) B.C. Hydro shall abide by the recommendations contained in the Environmental Impact Statement as ftled with the Application. (iv) B.C. Hydro shall be subject to further direction from the Commission on any matter arising from the environmental impact studies and the public consultation program. 4. B.C. Hydro is required to file monthly construction progress reports and provide the Commission with a final report on the project's completion.
