On October 17, and December 13, 1990 BC Gas Inc. - Lower Mainland Division ("BC Gas") applied to the Commission for approval of amendments to Rate Schedule 2601 and 2602 - Seasonal Off-Peak Service that reflect amended terms and conditions regarding certain penalty provisions; and B. The amendments provide for the charging of a penalty rate to customers during periods of unauthorized use at $18.84 per GJ; and C. Orders in Council No. 953/89 and 1819/88 require BC Gas to maintain rates for three years at the same level as those in effect at the time of the acquisition of British Columbia Hydro and Power Authority's Lower Mainland Gas Division on September 30, 1988. D. The Commission has reviewed the matter and finds that although the penalties applied for are reasonable, they require changes in rates. NOW THEREFORE the Commission orders as follows: 1. The Commission rejects the BC Gas Application dated October 17, 1990 pursuant to Order in Council No. 594/90 as it violates the rate freeze required by Orders in Council No. 953/89 and 1819/88.
