BEFORE: M.K. Jaccard, ) Chair; and ) September 29, 1992 L.R. Barr, ) Deputy Chair ) CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On August 27, 1992 BC Gas Inc. ("BC Gas"), applied to the Commission for approval of a Standard Form Franchise Agreement ("the Agreement") dated August 14, 1992 with the Village of Ashcroft ("the Municipality"), pursuant to Section 51 of the Utilities Commission Act ("the Act"); and B. The Agreement replaces a 21-year gas Franchise Agreement dated October 29, 1971 between Inland Natural Gas Co. Ltd., a predecessor company to BC Gas, and the Municipality that expired August 24, 1992; and C. The Municipal By-Law approving the Agreement is subject to approval in principle from the Minister of Municipal Mfairs, Recreation and Culture; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Agreement between BC Gas and the Village of Ashcroft dated August 14, 1992 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
