Jaccard, ) Chair, and ) October 8,1992 L.R. Barr, ) Deputy Chair ) o R D E R WHEREAS: A. On July 15, 1992 BC Gas Inc. ("BC Gas") filed an Application with the Commission for approval pursuant to Commission Decision and Order No. G-22-92 dated February 21, 1992. The Application addressed issues raised during the course of the public hearing and in Tab 4 provided amendments to the BC Gas Tariff in draft form; and B. The Commission received responses from intervenors concerning certain aspects of the draft tariff revisions, reviewed those submissions and now finds that a decision on industrial tariffs contained in the filing by BC Gas is necessary and in the public interest. NOW THEREFORE the Commission orders BCGas as follows: 1. Effective commencing November 1, 1992, the following Gas Tariffs are approved subject to timely filing of amendments as outlined in Appendix A of this Order: Rate Schedule 10 - Large Volume Sales & Sales Agreement For Schedules 10&13 Rate Schedule 13 - Peaking and Backstopping Gas Sales Rate Schedule 22 - Large Industrial Transportation Service & Transportation Agreement General Terms & Conditions Applicable To Large Industrial Transportation Service 2. The appropriate rate for Levell - Interruptible Transportation Service is not approved at this time and will be referred to a Public Hearing that will be set by future Commission Order 3. BC Gas is to inform all affected customers of the tariff changes and provide each large industrial customer served under each Schedule with an approved copy of the appropriate Rate Schedule. Appendix A Page 1 of 2 ClarjfjcatjonsJAmendments to Large Industrial Tariffs A. SCHEDULE 10 Sheet 10.03 "Minimum Charge" clarify that no minimum charge applies if level 2 only is taken. Sheet 10.04 "Other Provisions" clarify intent of final sentence in paragraph 5. Sheet 10.05 "Gas Supply" the time references in paragraph (a) and (b) should be made consistent, e.g. on the basis of local time. clarify that Schedule 13 nominations are deemed to be zero unless there is a sales nomination. Sheet 10.08 "Sales Agreement" correct the reference in paragraph 8.3 to read "8.1 rather than 9.1". B. SCHEDULE 13 Sheet 13.03 "Special Provisions" specify under paragraph 3 that Schedule 10 has first priority, followed by all others, Le. only 2 levels of priority. C. SCHEDULE 22 Sheet 22.Q2 "Level 1 Service" (In order that the various concerns about level 1 expressed by intervenors can be properly addressed, the Commission has decided that level 1 should not be offered until after review at a public hearing.) Therefore, BC Gas should remove the level 1 rates and insert the following clause on Sheet 22.02: IfA vailability Level 1 service will not be available until an appropriate rate has been determined by the B.C. Utilities Commission following a Rate Design Hearing. If Sheet 22.04 "Minimum Charge" clarify that the minimum charge for interruptible only applies in the absence of firm service and otherwise the firm service minimum takes precedence. Sheet 22.06 re: Demand Surcharge clarify that the surcharge only comes into effect after two days (Le. there are two days grace) but that the calculation is on the basis of averaging the two maximum occurrences. SCHEDULE 22 - Transportation Agreement page 1 "Transportation of Gas" delete paragraph 1.2 page 4 "Utility Gas Supply" revise paragraph 6.3 as per the previous Schedule 22 for Inland Division so that force majeure applies to all events upstream of Westcoast. page 5 "Force Majeure" in paragraph 8.1, four lines from the bottom, correct to read "Shipper" instead of "BC Gas". E. GENERAL TERMS AND CONDITIONS Sheet GTC. 02 "Definitions" in paragraph (e) a volume conversion should be stated as a basis for the assessment of penalties. Sheet GTC. 07 "Nominations. .. " clarify the last sentence in paragraph 3.3 to indicate that an increase in the nomination by BC Gas does not provide the Shipper an opportunity to revise its nomination. Sheet GTC. 11 "Prorata Indemnification" delete this section and incorporate billing instructions into the previous section,
