Newlands, ) February 13, 1992 Deputy Chainnan; and ) N. Martin, ) Commissioner ) CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On January 14, 1992 BC Gas Inc. ("BC Gas"), applied to the Commission for approval of a Franchise Agreement ("the Agreement") dated February 15, 1991 for a 21-year term commencing January 1, 1990 and expiring December 31,2011 with the Corporation of the City of Revelstoke ("the City"), pursuant to Section 51 of the Utilities Commission Act ("the Act"); and B. The Agreement replaces an August 15, 1990 interim gas Operating Agreement between BC Gas and the City that was approved by Commission Order No. G-61-90; and C. The City By-Law approving the Agreement is subject to approval in principle from the Minister of Municipal Affairs, Recreation and Culture; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Franchise Agreement between BC Gas and the Corporation of the City of Revelstoke dated February 15, 1991 for a 21 year term commencing January 1, 1990 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
