Newlands, ) February 13, 1992 Deputy Chainnan; and ) N. Martin, ) Commissioner ) CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On January 20, 1992 BC Gas Inc., (tlBC Gas tl ), applied to the Commission for approval of a Standard Form Franchise Agreement (tithe Agreement tl ) dated March 13, 1990 with the Village of Clinton (tithe Municipalitytl), pursuant to Section 51 of the Utilities Commission Act (tithe Act tl ); and B. The Agreement replaces a 21-year gas Franchise Agreement dated February 3, 1969 between Inland Natural Gas Co. Ltd., a predecessor company to BC Gas, and the Municipality that expired February 3, 1990; and C. The Municipal By-Law approving the Agreement is subject to approval in principle from the Minister of Municipal Affairs, Recreation and Culture; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Agreement between BC Gas and the Village of Clinton dated March 13, 1990 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
