IN TIlE MAT IER OF the Utilities Commission Act, S.B.e. 1980, c. 60, as amended and IN TIlE MA TIER OF Complaints Concerning BC Gas Inc. and Commission Order No. G-60-91 BEFORE: J.G. McIntyre, ) Chairman; ) J.D.V. Newlands, ) Deputy Chairman; and ) September 24, 1991 N. Martin, ) Commissioner ) o R D E R WHEREAS: A. Commission Order No. G-60-91 required BC Gas Inc. - Lower Mainland Division ("BC Gas") to refund any excess charges collected under Rate Schedule 2007 Firm Transportation Service for imbalance quantities from January 18, 1990, the date upon which the tariff was approved by Order in council No. 93; and B. On August 8, 1991 BC Gas requested the Commission to reconsider its decision pursuant to Order No. G-60-91 and questioned the Commission's jurisdiction over this matter; and C. On September 20, 1991 BC Gas reafftrmed its view that the appropriate authority to adjudicate the complaint was the Lieutenant Governor in Council; and D. The Commission has reviewed the complaint, and subsequent submissions and conftrms that jurisdiction lies with the Lieutenant Governor in Council. NOW THEREFORE the Commission hereby orders as follows: 1. Commission Order No. G-60-91 is cancelled. 2. The complaint into the double charging of transportation service charges by BC Gas has been referred to the Lieutenant Governor in Council.
