("WKP") filed for Commission approval, as an Energy Supply Contract pursuant to Section 85.3 of the Utilities Commission Act ("the Act"), agreements with Cominco Ltd. entitled: 1. Long Term Firm Power Supply Agreement 2. 1999 Firm Power Supply Agreement; and B. The Cominco power supply contracts are intended to replace the Consolidated Sale of Surplus Agreement between Cominco Ltd. and West Kootenay Power Ltd. dated Ianuary 3, 1989; and C. On August 30, 1991 Cominco Ltd. applied to the Minister of Energy, Mines and Petroleum Resources for amendment of the present Cominco Exemption Order to reflect the implementation of both Agreements; and D. The Commission now requires the Application to be set down for public hearing. NOW THEREFORE the Commission orders West Kootenay Power Ltd. as follows: 1. A public hearing is to commence at 9:00 a.m. local time, Tuesday, October 29, 1991 at the Uplander Hotel, 1919 Columbia Avenue, Rossland, B.C. 2. WKP will arrange for publication, not later than Friday, October 4, 1991, of a Notice of Public Hearing, as per attached copy, in one issue of each of the Vancouver Sun, The Province and such other appropriate local news pUblications as may properly provide adequate Notice to the population in the service area of the utility. 3. The Application and supporting material is to be made available for inspection at the Head Office of West Kootenay Power Ltd., Waneta Plaza, 8100 Rock Island Highway, Box 130, Trail, B.C., VIR 4L4; and at its District Offices located at Castlegar, Crawford Bay, Creston, Grand Forks, Greenwood, Kaslo, Kelowna, Keremeos, Oliver, Osoyoos, Penticton, Salmo, South Slocan, and Trail, B.c. 4. WKP is to file with the Commission not later than Friday, October 4, 1991, any prepared testimony and supplemental material upon which it intends to rely. 7. Intervenors and Interested Persons intending to be present and participate in the public hearing should give written Notice of Intention to do so to the Commission Secretary and to the Applicant, to be received not later than Friday, October 11, 1991. Such Notice should state the nature of the interest in the proceeding. 8. Intervenors and Interested Persons intending to file a written submission or to make a request for additional information of the Applicant should provide one copy to the Commission Secretary, and one copy to the Applicant, to be received not later than Friday, October 18, 1991.
