Newlands, ) Deputy Chairman; ) May 3,1991 N. Martin, ) Commissioner; and ) W.M. Swanson, Q.C., ) Commissioner ) ORDER WHEREAS: A. Bill 55-1987 dated July 16, 1987, approved the assignment and transfer of the powers and duties of the Minister of Transportation and Highways for the economic regulation of IntraProvincial Oil Pipeline Companies under Part 7 of the Pipeline Act, RSBC c. 328 (lithe Act") to the British Columbia Utilities Commission (lithe Commission "); and B. On April 26, 1991 Trans Mountain Enterprises of British Columbia ("TME") applied under Section 44 of the Act for approval of a toll increase on its Jet Fuel Pipeline effective immediately; and C. On May 9, 1991 TME provided the Commission with concurrence of the toll increase, from Canadian Airlines International Ltd. ("CAI"), one of the shippers on the Jet Fuel Pipeline; and D. The rates contained in the Tariff apply to the gathering and transportation of jet fuel from connected refineries, storage facilities and marketing terminals in the Greater Vancouver area to the Vancouver International Airport; and E. The Commission has considered TME's Application and finds that it is in accordance with the requirements of the Act. NOW THEREFORE the Commission orders as follows: 1. TME's Application dated April 26, 1990 to increase tolls on its Jet Fuel Pipeline as a result of decreased throughput is approved effective April 26, 1991. 2. TME will fIle with the Commission by May 31, 1991 an amended Turbine Fuel Tariff that reflects the increased tolls resulting from the decreased throughput.
