BEFORE: M.K. Jaccard, Chair; and ) L.R. Barr, Deputy Chair ) April 15, 1993 WHEREAS: A. On March 29, 1993 BC Gas Inc. - Columbia Division ("BC Gas") applied to the Commission for approval of a Standard Form Franchise Agreement (tithe Agreement") dated August 6, 1991 with the District of Sparwood ("the Municipality"), for a Primary Term from September 10, 1990 to September 9, 2000, pursuant to Section 51 of the Utilities Commission Act ("the Actlt); and B. The Agreement replaces a 21-year gas Franchise Agreement dated September 10, 1969 between Columbia Natural Gas Limited, a predecessor company to BC Gas, and the Municipality that expired September 10, 1990; and C. Municipal By-Law No. 575, 1991 approved the Agreement which received approval in principle from the Minister of Municipal Affairs, Recreation and Culture on June 26, 1991; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Standard Form Franchise Agreement between BC Gas and the District of Sparwood dated August 6, 1991 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
