Section 85.3 of the Utilities Commission Act ("the Act") requires that Energy Supply Contracts between producers and consumers be filed with the Commission for approval; and B. Algonquin Power Corporation Inc. ("Algonquin") filed with the Commission by letter dated September 13, 1993 an Electricity Purchase Agreement dated July 30, 1990 between Scuzzy Creek Hydro & Power Inc. ("Scuzzy Creek") and British Columbia Hydro and Power Authority ("B.C. Hydro") along with Letter Agreements to the Contract dated September 6, 1991, February 27 and 28, May 7 and August 19, 1992 and February 26, 1993 ("the Agreements"); and C. The Agreements provide for the supply of up to 6,000 kW by Scuzzy Creek to B.C. Hydro for a period of twenty years at unit price based on standard independent power producer rates. B.C. Hydro will also pay an incentive rate to Scuzzy Creek for the supply of power to Boston Bar should B.c. Hydro's power line to the community fail; and D. The Commission has reviewed the Agreements including technical data and is satisfied that approval is necessary and in the public interest. NOW THEREFORE pursuant to Section 85.3 of the Act the Commission orders as follows: The Commission approves and accepts for filing the Electricity Purchase Agreement dated July 30, 1990 including Letter Agreements to the Contract dated September 6, 1991, February 27 and 28, May 7 and August 19, 1992, .. ./2
and February 26, 1993 between B.C. Hydro and Scuzzy Creek Hydro & Power Inc. covering the supply of power from Scuzzy Creek's hydro-electric plant near Boston Bar, B.C., for a period of20 years.
