BEFORE: M.K. Jaccard, Chair; ) L.R. Barr, Deputy Chair, and ) February 17, 1993 K.L. Hall, Commissioner ) WHEREAS: A. On January 27, 1993 BC Gas Inc. ("BC Gas") applied to the Commission for approval of a Standard Form Franchise Agreement ("the Agreement") dated September 30,1991 with the Village of Midway ("the Municipality") for a primary term of ten years, pursuant to Section 51 of the Utilities Commission Act ("the Act"); and B. The Agreement replaces a 21-year gas Franchise Agreement dated July 15, 1968 between Inland Natural Gas Co. Ltd., a predecessor company to BC Gas, and the Municipality that expired July 14, 1989; and C. Municipal By-Law No. 208, 1991 approved the Agreement and received approval in principle from the Minister of Municipal Affairs, Recreation and Culture on September 16, 1991; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Agreement between BC Gas and the Village of Midway dated September 30, 1991 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
