AN ORDER IN THE MATTER OF the Utilities Commission Act, S.B.C. 1980, c. 60, as amended and An Application by Tlingit & Haida Regional Electrical Authority BEFORE: M.K. Jaccard, Chairperson; L.R. Barr, Deputy Chairperson; and K.L. Hall, Commissioner WHEREAS: A. On June 10. 1993 Tlingit & Haida Regional Electrical Authority ("THREA") applied to the British Columbia Utilities Commission ("the Commission") for exemption from the provisions of the Utilities Commission Act ("the Act") , other than Part 2, in respect of the sale of electricity by THREA to the Government of Canada's border station located at Pleasant Camp. B.C.; and B. There is no other electrical distribution facility in the area; and C. The Commission has considered the Application and is satisfied that an Order exempting THREA from certain sections of the Act properly conserves the public convenience and interest; and D. On September 8, 1993 the Lieutenant Governor in Council approved the said exemption by issuing Order in Council No. 1187. 1993 attached hereto as Appendix A; and E. The Commission may, pursuant to Section 114 of the Act, reconsider, vary or rescind an Order made by it. NOW THEREFORE Pursuant to Section 103 of the Act, the Commission approves and orders as follows: The sale of power by THREA to the Government of Canada's border station at Pleasant Camp, B.C. is exempt from the Act. other than Part 2.
