BEFORE: M.K. Jaccard, Chairperson; and) December 8, 1993 K.L. Hall, Commissioner ) WHEREAS: A. On November 30, 1993 West Kootenay Power Ltd. ("WKP") filed with the Commission, pursuant to Section 67 and 106 of the Utilities Commission Act (lithe Act"), an Application requesting a Commission Order granting an interim refundable rate increase of 7.6 percent uniformly to all classes of service effective with consumption on and after January I, 1994 along with a further increase of 5.6 percent on January 1, 1995 (lithe Rate Application"); and B. On December 3, 1993 WKP made applications to the Commission for approval of rate design methodology (lithe Rate Design Application") with such changes to be considered in a public forum; and C. WKP advised the Commission that its draft Integrated Resource Plan (lithe IRP") will be filed with the Commission in December, 1993; and D. The Commission has reviewed the Rate Application, the Rate Design Application and the draft IRP and requires that the matters be set down for public hearing; and NOW THEREFORE the Commission orders as follows: 1. The application by WKP for an interim increase over existing rates of 7.6 percent effective January 1, 1994 will be decided by way of a future Commission Order. 2. A public hearing into the Applications and the draft IRP will commence at 9:00 a.m. on March 7, 1994 at the Uplander Hotel, 1919 Columbia Avenue, Rossland, B.C. 3. WKP will arrange for publication in display-ad format, not later than December 17, 1993, of a Notice of Public Hearing, as per attached copy, in the business sections of the Vancouver Sun, The Province and such other appropriate local news publications in the service area of the Utility so as to provide adequate notice to the public. 4. The Applications and supporting material are to be made available for inspection at the Head Office of West Kootenay Power Ltd., 1290 Esplanade, P.O. Box 130, Trail, B.C., VIR 4L4; and at its District Offices located at Castlegar, Crawford Bay, Creston, Grand Forks, Greenwood, Kaslo, Kelowna, Keremeos, Oliver, Osoyoos, Penticton, Salmo, South Slocan and Trail, B.C. The Applications and supporting material are also available for inspection at the office of the British Columbia Utilities Commission, 6th Floor, 900 Howe Street, Vancouver, B.C. V6Z 2N3.
2 5. WKP is to distribute copies of the Applications and any supplemental infonnation to Intervenors as they become registered with the Commission. WKP is to distribute an Executive Summary of the Applications to Interested Parties. The Executive Summary is to include, as a minimum, references to the 1994 and 1995 Application for Revenue Requirements, Rate Design proposals and the draft Integrated Resource Plan. 6. WKP is to file with the Commission, not later than December 17, 1993, any additional prepared testimony and supplemental material upon which it intends to rely. 7. Not later than December 31, 1993, Intervenors intending to be present and participate in the public hearing should give written notice of intention to do so to the Commission Secretary and to the Applicant. Such notice should state the nature of the interest in the proceeding. 8. Registered Intervenors and Interested Parties intending to make requests for additional infonnation from the Applicant should do so by January 17, 1994. Infonnation Requests made by January 17, 1994 shall be responded to by WKP on or before January 31, 1994. 9. Registered Intervenors intending to file written evidence pertaining to the Application must do so with the Commission and the Applicant by February 11,1994. (tlWKPtI) applied to the Commission for an order approving an interim refundable rate increase of 7.6 percent applied uniformly to all classes of service effective with consumption on and after January 1, 1994 along with a further increase of 5.6 percent on January 1, 1995. 2. On December 3, 1993 WKP also applied to the Commission for rate design changes affecting residential, commercial, industrial and other classes of service. 3. WKP will be filing its draft Integrated Resource Plan. THE PUBLIC HEARING The Applications will be heard commencing at 9:00 a.m. local time, Monday, March 7, 1994 in Rossland B.C. at the location indicated above. The Division named to review the Application will be comprised of the following Commission members: Dr. Mark K. Jaccard, Chairperson Mr. Kenneth L. Hall, Commissioner Ms. Margaret R. Payne, Commissioner PUBLIC INSPECTION OF THE APPYCATIONS The Applications, supporting material and Commission Order No. G-118-93 are available for inspection at the following locations: West Kootenay Power Ltd. Copies of the Applications and supporting material are also available for inspection at the office of the British Columbia Utilities Commission, Sixth Floor, 900 Howe Street, Vancouver, B.C. INTERYENTIONS Any person wishing to be present at the public hearing and to give evidence or cross-examine witnesses should provide written notice, to be received not later than December 31, 1993, to the Commission Secretary and to the Applicant. The notice should include a brief statement as to the nature of the interest in the proceedings and should indicate whether they intend to appear at the hearing. INFORMATION REOUESTS Registered Intervenors or Interested Parties requesting additional information from the Applicant should do so by January 17, 1994. Information Requests made by that date shall be responded to by January 31, 1994. SUBMISSIONS BY INTERYENORS Written evidence from Intervenors is required to be filed, one copy each, with the Commission Secretary and WKP, by February 11, 1994.
