Limited BEFORE: M.K. Jaccard, Chair; and ) March 24, 1993 L.R. Barr, Deputy Chair ) WHEREAS: A. On March 12, 1993 Pacific Northern Gas Ltd. ("PNG") applied to the Commission, pursuant to Section 61(6) of the Utilities Commission Act ("the Act"), for approval of the acquisition by PNG of all of the issued and outstanding shares ("the Application") of Northland Utilities (B.c.) Limited ("Northland") owned by Northwestern Utilities Limited ("Northwestern") located in Edmonton, Alberta; and B. On March 15, 1993 Northland applied for Commission approval ("the Application") to transfer the shares of Northland from Northwestern to PNG; and C. Northland is a regulated energy utility operating natural gas grid systems in Dawson Creek, Pouce Coupe, Rolla and Tumbler Ridge, B.C.; and D. The District of Tumbler Ridge and the Peace River Regional District have requested, in writing, that the Commission hold a public hearing into the Application; and E. The Commission has concluded that there is sufficient public interest in the Application to be heard in a public forum. NOW THEREFORE the Commission orders PNG and Northland as follows: 1. The Applications by PNG and Northland for the transfer of the outstanding shares of Northland is set down for public hearing to commence at 11:30 a.m. local time on Wednesday May 5, 1993 at the George Dawson Inn, 11705 - 8th Street, Dawson Creek, B.C. PNG and Northland will arrange for publication of the Notiee of Public Hearing, attached as Appendix A, in one issue of newspapers generally covering the Dawson Creek, Pouee Coupe, Rolla and Tumbler Ridge service areas. 3. PNG and Northland will file with the Commission on or before Wednesday, April 21, 1993 any additional or amended material, including prepared direct testimony, upon which they intend to rely. 4. PNG and Northland will provide expeditiously, to any interested party so requesting, copies of all material filed with the Commission in respect of the Applications. 5. Any interested party intending to be present and participate in the public hearing and who may intend to present a written submission pertaining to this matter should provide one copy each to the Commission Secretary, and to PNG and Northland not later than Wednesday, April 21, 1993. Limited ("Northland") have applied to the British Columbia Utilities Commission ("the Commission") under Section 61 (6) of the Utilities Commission Act ("the Act"), for Commission approval of the acquisition by PNG of all of the outstanding shares of Northland owned by Northwestern Utilities Limited of Edmonton, Alberta. Northland operates natural gas distribution systems in Dawson Creek, Pouce Coupe, Rolla and Tumbler Ridge, B.c. THE PUBLIC HEARING The Commission has ordered that the PNG and Northland Applications for the acquisition and transfer of Northland be heard in public commencing at 11:30 a.m. local time, on Wednesday May 5, 1993 at the George Dawson Inn, 11705 - 8th Street, Dawson Creek, B.C. VIG 4N9. Section 61(8) of the Act states: "The Commission may give its approval under this section subject to conditions and requirements it considers necessary or desirable in the public interest, but the Commission shall not give its approval under this Section unless it considers that the public utility and the users of the service of the public utility will not be detrimentally affected." INSPECTION OF APPLICATION MATERIAL Copies of the Applications and supporting materials filed with the Commission will be available for inspection at the offices of the Commission located on the 6th Floor, 900 Howe Street, Vancouver, B.C., and at the following locations: Pacific Northern Gas Ltd. #1400 - 1185 West Georgia Street Vancouver, B.c. V6E 4E6 Northland Utilities (B.c.) Limited 10035 - 105 Street Edmonton, Alberta T5J 2V6 District Offices in Dawson Creek, Pouce Coupe, Rolla and Tumbler Ridge, B.C. Copies of the Application documents and supporting materials may be obtained from PNG or Northland on request.
