Jaccard, Chairperson; and ) L.R. Barr, Commissioner ) March 25, 1994 ORDER WHEREAS: A. On March 10, 1994 British Columbia Hydro and Power Authority ("B.C. Hydro") applied to the Commission, under Section 85.3 of the Utilities Commission Act ("the Act"), for approval of an Electricity Purchase Agreement ("the Agreement") dated December 24, 1993 between B.c. Hydro and CPI, Canyon Power Incorporated ("CPI, Canyon") for the supply of electricity to B.C. Hydro at Lytton, B.C.; and B. B.C. Hydro requested that the Agreement remain confidential as it contained sensitive business information which may prove to compromise B.C. Hydro's future bargaining position; and C. The Agreement is the result of an open solicitation by B.C. Hydro in January 1993 for "uniquely positioned" Independent Power Producer projects at economic prices; and D. The project proponent has received the necessary Waste Management Permit from the Ministry of Environment, Lands and Parks; and E. The Commission has reviewed the Agreement and supporting documentation and is satisfied that the Agreement is necessary and in the public interest. NOW THEREFORE the Commission orders as follows: 1. The Electricity Purchase Agreement dated December 24, 1993 between B.c. Hydro and CPI, Canyon for the supply of electricity to B.C. Hydro at Lytton, B.C. is approved. 2. B.C. Hydro's request for confidentiality of the Agreement is approved at this time. The Commission reserves the right however, to revisit the issue of confidentiality of this Agreement at a later date should it be deemed necessary.
