BEFORE: M.K. Jaccard, Chairperson; and ) K.L. Hall, Commissioner ) November 10, 1993 ORDER WHEREAS: A. On October 27, 1993 West Kootenay Power Ltd. (tfWKPtf) applied for Commission approval to supply power, on an interim basis, to British Columbia Hydro and Power Authority (tfB.C. Hydro tf ) at Yahk, Lardeau and the Hugh Keenleyside Dam, in accordance with an Addendum to the Rate Schedule 3808 Power Purchase Agreement and Tariff Supplement No.7; and B. WKP notified B.C. Hydro that it was terminating the contracts for service to these points supplied for some years under Wholesale and Industrial rates; and C. WKP advised the Commission that the supply of power to the three points of delivery to B.c. Hydro should be on a standard inter-utility basis using a tfnet billing approachtf in order to eliminate cross-subsidy of rates and an unfair burden on all other WKP customers; and D. The Commission has reviewed the Application and finds that, under Section 106 of the Utilities Commission Act, the special circumstances of the case do not require an interim order. NOW THEREFORE the Commission orders as follows: 1. The Application by WKP for interim approval covering the supply of power by WKP to B.C. Hydro at the points of delivery at Yahk, Lardeau and the Hugh Keenleyside Dam is denied. 2. The rates charged by WKP prior to the termination of the contracts are to continue in effect until such time as the matter of rates and conditions of supply to B.C. Hydro can be addressed. 3. WKP is to address the issue of rates and supply of power to B.c. Hydro at the three points of delivery in its next rate design application.
