BEFORE: M.K. Jaccard, Chairperson; and ) K.L. Hall, Commissioner ) April 13, 1994 ORDER WHEREAS: A. On December 13, 1993 and February 1, 1994 BC Gas Utility Ltd. ("BC Gas") filed with the Commission for approval an Energy Supply Contract amendment for the Fort Nelson Division in the form of a Letter Agreement with Westcoast Energy Inc. ("WEI") and CanWest Gas Supply Inc. ("CanWest"); and B. The Commission has considered the Application and Letter Agreement and is satisfied that approval is necessary and in the public interest. NOW THEREFORE pursuant to Section 85.3 of the Utilities Commission Act and the Rules thereunder, the Commission orders BC Gas as follows: 1. The Commission approves for BC Gas Fort Nelson Division the Letter Agreement with WEI and CanWest dated November 16, 1993 amending the Gas Purchase Contract dated November 1, 1965. 2. The restructuring of the Division's gas supply arrangements for the 1996/97 Gas Contract Year will require a demonstration, in the context of BC Gas' Integrated Resource Plan process, that the changes are in the public interest. 3. BC Gas is directed to bring the baseload portion of its gas supply arrangements for Fort Nelson into compliance with the Rules for Energy Supply Contracts by June 30, 1995 and to file a report at the end of each calendar quarter on the progress it has made towards restructuring the arrangements.
