On October 26, 1992 Hemlock Valley Electrical Services Limited ("HYES") applied to amend the amortization period and accounting treatment relating to its rate hearing costs and the costs associated with its appearance in the Court of Appeal; and B: HVES stated that if the amortization period for such costs approved by Order No. 0-39-92 is extended from three to five years it will avoid a general increase in rates for the fiscal period ending April 30, 1993; and C. On November 2, 1992 HYES also applied to increase its Electric Tariff, Minimum Monthly Charge from $15 to $25 effective September 1, 1992; and D. On January 24, 1993 HYES reviewed its Application and applied to amend the increase in the Minimum Monthly Charge from $15 to $20 effective January 1, 1993. E. The Commission has reviewed the Applications and finds that approval, pursuant to Section 67 (4) of the Utilities Commission Act, is required. NOW THEREFORE the Commission orders HVES as follows: 1. The Commission approves for HVES the extension of the amortization period from three years to five years for costs associated with its appearance in the Court of Appeal, and deferral of the amortization of its rate hearing costs. 2. The Application by HVES to increase the Electric Tariff, Minimum Monthly Charge from $15 to $20 is approved effective February 1, 1993, pursuant to Section 67 (4) of the Act. 3. HYES will mail a copy of the Commission's letter, attached as Appendix A to this Order, to all affected customers. V6Z 2N3 BC TOLL FREE: 1-800-663-1385 CANADA FACSIMILE: (604) 660-1102 Appendix A February 17, 1993 To All Customers of Hemlock Valley Electric Services Limited Hemlock Valley Electrical Services Limited ("HVES") applied November 2, 1992 to increase its Electric Tariff, Minimum Monthly Charge from $15 to $25 effective September 1, 1992. On January 24, 1993 HVES reviewed its application and revised its proposed increase in the minimum monthly charge from $15 to $20 and to be effective January 1, 1993. A copy of that application is available for inspection at the offices of HVES or at the B.C. Utilities Commission, located at 600 - 900 Howe Street, Vancouver, B.C. V6Z 2N3. The Commission has reviewed the application and has ordered that the increase in the Minimum Monthly Charge is to become effective on and after February 1, 1993. The delay from January 1, 1993 was made in order for customers to be properly notified of the pending increased minimum monthly charge. The authorization is made pursuant to Section 67 (4) of the Utilities Commission Act which reads as follows: 67 (4) A public utility may file with the commission a new schedule of rates that the utility considers to be made necessary by a rise in the price, over which the utility has no effective control, required to bepaid by the public utility for its gas supplies, other energy supplied to it, or expenses and taxes, and the new schedule may be put into effect by the public utility on receiving the approval of the commission, but if within 60 days after the date the commission approves the new schedule the commission either on complaint of a person whose interests are affected or on its own motion directs an inquiry into the new schedule of rates having regard to the fixing of a rate that is not unjust or unreasonable, the commission may after the inquiry rescind or vary the increase and order a refund or customer credit by the utility of all or part of the money received by way of increase, or may confirm the increase or part of it.
