BEFORE: M.K. Jaccard, Chairperson; and ) F.e. Leighton, Commissioner ) July 5, 1994 CERTIFICA TE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On June 8, 1994 BC Gas Utility Ltd. - Inland Division ("BC Gas") applied to the Commission, pursuant to Section 51 of the Utilities Commission Act ("the Act"), for approval of a Standard Form Franchise Agreement ("the Agreement") dated October 16, 1993 with the Village of Keremeos ("the Municipality") for a primary term of ten years; and B. The Agreement replaces a 21-year Gas Franchise Agreement for the period October 18, 1972 to October 15, 1993, between Inland Natural Gas Co. Ltd., a predecessor company to BC Gas, and the Municipality; and e. Municipal By-Law No. 471, 1994 approved the Agreement and received approval in principle from the Minister of Municipal Affairs, Recreation and Culture on January 19, 1994; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Agreement between BC Gas and the Village of Keremeos, dated October 16, 1993 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
