("Harmac") applied to the Commission pursuant to Section 103(3) of the Utilities Commission Act ("the Act") for an order exempting it from regulation as a public utility with regard to its sale of steam to Canadianoxy Industrial Chemicals Limited Partnership ("Canoxy"); and B. The sale of steam is pursuant to an agreement dated March 28, 1963 ("the Agreement") between predecessor companies to Harmac and Canoxy and does not provide for the sale of steam to any other party; and e. Harmac has requested that the exemption order be made effective May 26, 1994, the date upon which Harmac took over responsibility for the Agreement; and D. The Commission has considered Harmac's application and is satisfied that an Order exempting Harmac from regulation under Part 3 of the Act properly conserves the public convenience and interest; and E. The Commission may, pursuant to Section 114 of the Act, reconsider, vary or rescind an Order made by it. .. ./2
2 G-69-94 NOW THEREFORE the Commission orders as follows: 1. The sale of steam by Harmac to Canoxy is exempt from Part 3 of the Act effective May 26, 1994. 2. This exemption order is transferable to any future owner of the Harmac pulp mill and/or any future owner of the Canoxy plant, but this order shall terminate in the event that steam is sold to any other party. 3. This exemption order shall not have any force and effect until after the date upon which it is approved by the Lieutenant Governor in Council ("LGIC"), pursuant to Section 103(3) of the Act. 4. Following approval by the LGIC, the Order in Council will form part of this Order as Appendix A. DATED at the City of Vancouver, in the Province of British Columbia, this day of October, 1994.
