BEFORE: M.K. Jaccard, Chairperson; and ) K.L. Hall, Commissioner ) February 3, 1994 ORDER WHEREAS: A. On January 17, 1994 BC Gas Utility Ltd. - Columbia Division ("BC Gas") applied to the Commission for approval of a Standard Form Franchise Agreement ("the Agreement") dated November 1, 1992 with the District of Elkford ("the Municipality") for a primary term of ten years, pursuant to Section 51 of the Utilities Commission Act ("the Act"); and B. The Agreement replaces a 21-year gas Franchise Agreement dated November 1, 1971 between Columbia Natural Gas Limited, a predecessor company to BC Gas, and the Municipality that expired November 1, 1992; and C. Municipal By-Law No. 466, 1993 approved the Agreement and received approval in principle from the Minister of Municipal Affairs, Recreation and Culture on August 24, 1993; and D. The Commission has reviewed the BC Gas Application and supporting documentation and finds that approval of the Agreement is necessary for the public convenience and properly conserves the public interest. NOW THEREFORE, pursuant to Section 51(4) of the Act, the Commission approves the Agreement between BC Gas and the District of Elkford dated November 1, 1992 provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
