Jaccard, Chairperson; ) K.L. Hall" Commissioner; and ) January 27, 1994 E.e. Sleath, Commissioner ) ORDER WHEREAS: A. On February 19, 1993 British Columbia Hydro and Power Authority ("Re. Hydro", "the Applicant") filed with the Commission an Application, pursuant to Sections 64, 67, 106 and 114 of the Utilities Commission Act ("the Acf') and Special Direction No.8, to increase rates on an interim and permanent basis to all customers effective April 1, 1993; and B. The Application also requested an Order pursuant to Section 114 of the Act varying paragraph 6 of Commission Order No. 0-31-90; and C. On December 7, 1993 the Commission, by Order No. 0-116-93, approved a 3.9 percent rate increase to all classes of electric service customers effective April 1, 1993, adjusted for rate design proposals, and also approved a variation of Commission Order No. 0-31-90, all as set out in the Decision issued concurrently with Order No. 0-116-93; and D. By letter dated December 30, 1993, the Council of Forest Industries of British Columbia, the Mining Association of British Columbia and the Electro-Chemical Producers (the "Industrial Users") requested that the Commission reconsider and vary its Decision pursuant to Section 114 of the Act; and E. By letter dated January 6, 1994, the Commission invited all interested parties to make submissions, on or before January 17, 1994, in response to the Industrial Users' request for reconsideration and variation; and
F. B.C. Hydro, by letter dated January 10, 1994, responded to the Industrial Users' request for reconsideration and variance. NOW THEREFORE the Commission, having considered the December 30, 1993 request by the Industrial Users for reconsideration and variance of Commission Order No. 0-116-93 and the January 10, 1994 response from B.C. Hydro, orders as follows: The Industrial Users' request for reconsideration and variance is hereby denied on the basis that the request does not disclose the existence of any new evidence, nor does it establish any other grounds sufficient to justify a reconsideration of Commission Order No. 0-116-93.
