BEFORE: M.K. Jaccard, Chairperson; and ) K.L. Hall, Commissioner ) July 14, 1994 ORDER WHEREAS: A. On November 1, 1993 BC Gas Utility Ltd. - Columbia Division ("BC Gas") applied to the Commission for approval-in-principle of the establishment of a bypass rate to its customer Crestbrook Forest Industries Ltd. ("Crestbrook") for the Elko, B.C. Sawmill, effective with consumption on and after November 1, 1993; and B. BC Gas advised the Commission of the complexities involved in determining a bypass rate for Crestbrook prior to November 1, 1993 and requested approval to file the rate no later than December 31, 1993 and to establish a deferral account to capture any arising revenue deficiency for future flow-through purposes. The Commission approved the Application and issued Order No. G-112-93; and C. On June 6, 1994 BC Gas made a final application ("the Application") for approval of rates to Crestbrook as a result of a standard bypass model similar to that used for two other customers and negotiations with Crestbrook using the customers' bypass alternative; and D. BC Gas advised the Commission that approval of the Application would require a deferral account approved by Order No. G-112-93 only for the months of November and December 1993 and the 1994 and 1995 test year date need not be adjusted; and E. The Commission has reviewed the Application and is satisfied that approval is necessary and in the public interest. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for BC Gas the June 6, 1994 draft Bypass Transportation Agreement for Rate Schedule 22 with Crestbrook, effective November 1, 1993. 2. The Commission will accept, subject to timely filing by BC Gas in Tariff Supplement format, the Bypass Transportation Agreement with Crestbrook.
