Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) December 7, 1995 ORDER WHEREAS: A. On October 25, 1993 the Commission issued its Decision on the BC Gas Utility Ltd. ("BC Gas") Phase B Rate Design Application ("the Decision") which required the Utility to amend its Burrard Thermal Interruptible Gas Purchase Agreement ("the Agreement") with British Columbia Hydro and Power Authority ("B.C. Hydro"). BC Gas complied with the Decision and filed a revised form of the Agreement by letter dated November 16, 1993; and B. B.C. Hydro requested a reconsideration of the Decision which was denied by Commission order G-20-94, and B.C. Hydro then argued the matter in the B.C. Court of Appeal where the appeal was dismissed; and C. BC Gas and B.C. Hydro subsequently resolved the outstanding issues respecting the Agreement and on November 28, 1995 BC Gas filed the amended Agreement for Commission approval as Tariff Supplement No. 1-4. The BC Gas filing also requested cancellation of two previously approved tariff supplements related to the interruptible sale of gas to B.C. Hydro; and D. The Commission has reviewed the BC Gas filing and is satisfied that approval is necessary and in the public interest. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for BC Gas, Tariff Supplement No. 1-4, Burrard Thermal Interruptible Gas Purchase Agreement with B.C. Hydro, effective September 1, 1995. 2. BC Gas Lower Mainland Tariff Supplement No. 11 and BC Gas Tariff Supplement No. I-I are both canceled. DATED at the City of Vancouver, in the Province of British Columbia, this day of December, 1995.
