Jaccard, Chairperson; L.R. Barr, Deputy Chairperson; and ) K.L. Hall, Commissioner ORDER WHEREAS: A. On March 28, 1995 West Kootenay Power Ltd. ("WKP") filed for Commission approval an October 10, 1994 Enabling/Service Agreement ("the Agreement") Company ("PGE") for an open-ended term with the provision that either party may withdraw upon 30 days notice; and B. The Agreement provides for the contractual mechanism under which future short-term purchases and sales of surplus energy, including storage, wheeling exchanges or other services can occur from PGE; and C. The Commission has reviewed the WKP filing and is satisfied that approval of the Agreement is necessary and in the public interest. NOW THEREFORE pursuant to Section 85.3 of the Utilities Commission Act and the Rules, the Commission approves the Agreement as follows: The Enabling/Service Agreement dated October 10, 1994 between WKP and PGE for an open-ended term.
