Jaccard, Chairperson; and ) September 28, 1995 L.R. Barr, Deputy Chairperson ) ORDER WHEREAS: A. On January 15, 1991, British Columbia Hydro and Power Authority ("B.C. Hydro") applied to the Commission for approval of its new Industrial Rate proposals; and B. The Application was reviewed in a public hearing which commenced on January 13, 1992; and C. In its Decision dated April 24, 1992, the Commission rejected the Application and advised B.C. Hydro to resubmit the Application at a later date, after further public discussion and a resolution of certain issues in the proposals; and D. B.C. Hydro has had requests from some of its large industrial customers to expedite the provision of services such as wheeling and back-up, which were components of B.C. Hydro's 1991 Industrial Rate Application; and E. On March 30, 1994, the Commission wrote to B.C. Hydro instructing the utility to file its proposals for new industrial service options and wheeling by May 20, 1994, for inclusion in the September 1994 Rate Application Hearing; and F. On May 24, 1994, B.c. Hydro responded to the Commission's March 30, 1994 letter proposing an approach which involved a process of public consultations with customers, leading to an application for Standby Service by May 31, 1994, and the application for wheeling and the other elements of the industrial proposal on the completion of the consultation program; and G. On June 24, 1994 B.C. Hydro wrote to the Commission proposing a schedule of public consultations on the Industrial Service Options/Rate Design, commencing in July 1994 and ending with an Application to the Commission in December 1994/January 1995; and H. On July 27, 1994, B.C. Hydro conducted a Consultation Session which was attended by the Commission, B.C. Hydro's Industrial Customers and other stakeholders to discuss details of its consultation schedule and obtain feedback on the issues to be addressed in its Industrial Service Options Application; and 1. On July 28, 1994 the Commission issued Order No. G-58-94 determining that a resolution of issues related to Industrial Service Options should be expedited and requiring a final Application on Industrial Service Options/Rate Design be made no later than January 3, 1995; and .. ./2
2 2-95 J. On December 15, 1994 the Province of British Columbia issued Order in Council No. 1536 directing the Commission to undertake a public review of the provincial electricity market; and K. On January 3, 1995 B.C. Hydro filed an application dated December 30, 1994 including a number of previous filings, all making up the Industrial Service Options; and L. On February 28, 1995 theCommissi()fi issuedOtdet No. 0 ..20..95 delayirigreview of the Illdllsll'ial Service Options filing until following the Electricity Market Review. The delay reflected the views of all parties at the February 22 and 23, 1995 EMR Review Workshop, including the industrial customers; and M. On August 1, 1995 B.C. Hydro wrote to the Commission seeking to withdraw its various applications in support of new Industrial Services and proposing a schedule of new filings to occur before December 31, 1995; and N. The Commission has considered the above and determines that a refiling of the applications related to wholesale wheeling and industrial services is required. NOW THEREFORE the Commission orders B.C. Hydro as follows: 1. B.C. Hydro is to refile its industrial service application, inclusive of a real-time pricing option, no later than December 31, 1995. That filing shall include the industrial services already proposed, along with services requested by industrial customers as an outcome of B.c. Hydro's ongoing negotiations with the industrial customers. 2. A proposed Wholesale Wheeling rate is to be filed no later than November 13, 1995.
