Jaccard, Chairperson; ) L.R. Barr, Deputy Chairperson; and ) May 15, 1995 K.L. Hall, Commissioner ) ORDER WHEREAS: A. On March 28, 1995 West Kootenay Power Ltd. ("WKP") filed for Commission approval an Enabling Agreement ("the Agreement") with the Bonneville Power Administration ("BPA") that covers a period of twenty years from November 8, 1994; and B. The Agreement, Contract No. DE-MS79-94BP94493, provides for the contractual mechanism under which future purchases and sales of surplus energy (firm, non-firm, and/or provisional), surplus capacity, power exchanges and other services will occur from time to time at the location of BPA's Boundary Substation or at another point of delivery agreed to by WKP and BPA; and C. The Commission has reviewed the WKP filing and is satisfied that approval of the Agreement is necessary and in the public interest. NOW THEREFORE pursuant to Section 85.3 of the Utilities Commission Act and the Rules, the Commission approves the Agreement as follows: The Enabling Agreement, identified as Contract No. DE-MS79-94BP94493, dated October 20, 1994 between BPA and WKP for a period of twenty years commencing November 8, 1994.
