Sandon Power System We refer to your October 25, 1995 application for discontinuance as a public utility under Section 47 of the Utilities Commission Act ("the Act"). The Commission has now received the information necessary to complete the processing of your application. However, a decision on your application is held in abeyance in light of recent discussions between yourself and Commission staff and a Mr. Ken Witzke, culminating in the attached December 13, 1995 letter to the Commission from Mr. Witzke. As articulated in the letter, Mr. Witzke intends to acquire the assets of the power system and continue to operate it as a public utility. Having regard to this recent development, the Commission wishes your formal advice on whether you require that your October 25, 1995 application be set aside and that you intend to file a new application for transfer of ownership to Mr. Witzke, or that you wish to continue with your application for discontinuance. Should you opt for a transfer of ownership, the Commission would require confirmation that you have provided Mr. Witzke with a copy of the most recent utility cost assessment, and have apprised him of all pertinent information with respect to the operation and maintenance of the power system. Mr. Witzke would also be required to provide information to the Commission with respect to the proposed operation of the power system before a decision is made.
