Jaccard, Chairperson; and ) January 25, 1996 L.R. Barr, Deputy Chairperson ) O R D E R WHEREAS: A. On January 15, 1991 British Columbia Hydro and Power Authority ("B.C. Hydro") applied to the Commission for approval of its new Industrial Rate proposals; and B. The Application was reviewed in a public hearing which commenced on January 13, 1992; and C. In its Decision dated April 24, 1992, the Commission rejected the Application and advised B.C. Hydro to resubmit the Application at a later date, after further public discussion and the resolution of certain issues in the proposals; and D. B.C. Hydro has had requests from some of its large industrial customers to expedite the provision of services such as wheeling and back-up, which were components of B.C. Hydro's 1991 Industrial Rate Application; and E. On March 30, 1994 the Commission wrote to B.C. Hydro instructing the utility to file its proposals for new industrial service options and wheeling by May 20, 1994, for inclusion in the September 1994 Rate Application Hearing; and F. On May 24, 1994 B.C. Hydro responded to the Commission's March 30, 1994 letter proposing an approach which involved a process of public consultations with customers, leading to an application for Standby Service by May 31, 1994, and the application for wheeling and the other elements of the industrial proposal on the completion of the consultation program; and G. On June 24, 1994 B.C. Hydro wrote to the Commission proposing a schedule of public consultations on the Industrial Service Options/Rate Design, commencing in July 1994 and ending with an Application to the Commission in December 1994/January 1995; and H. On July 27, 1994 B.C. Hydro conducted a Consultation Session which was attended by the Commission, B.C. Hydro's Industrial Customers and other stakeholders to discuss details of its consultation schedule and obtain feedback on the issues to be addressed in its Industrial Service Options Application; and I. On July 28, 1994 the Commission issued Order No. G-58-94 determining that a resolution of issues related to Industrial Service Options should be expedited and requiring a final Application on Industrial Service Options/Rate Design be made no later than January 3, 1995; and .../2

On December 15, 1994 the Province of British Columbia issued Order in Council No. 1536 directing the Commission to undertake a public review of the provincial electricity market; and K. On January 3, 1995 B.C. Hydro filed an application dated December 30, 1994 including a number of previous filings, all making up the Industrial Service Options; and L. On February 28, 1995 the Commission issued Order No. G-20-95 delaying review of the Industrial Service Options filing until following the Electricity Market Review. The delay reflected the views of all parties at the February 22 and 23, 1995 EMR Review Workshop, including the industrial customers; and M. On August 1, 1995 B.C. Hydro wrote to the Commission seeking to withdraw its various applications in support of new Industrial Services and proposing a schedule of new filings to occur before December 31, 1995. The Commission considered the request and issued Order No. G-82-95 which approved the delay in filing the ISO Application to December 31, 1995; and N. On December 7 and 8, 1995 the Industrial Customers and B.C. Hydro respectively, requested the ISO filing be delayed. The Commission, by Order No. G-107-95, approved the filing be delayed to January 22, 1996; and O. On January 22, 1996 B.C. Hydro filed its ISO application and requested approval of Rate Schedule 1848 - Real-Time Pricing ("RTP") Transmission Service (5,000 kvA and over) on an interim basis, effective January 31, 1996; and P. The Commission has reviewed the ISO application and finds that interim approval of RTP rates and a regulatory schedule of deadlines is required to be issued. NOW THEREFORE the Commission orders B.C. Hydro as follows: 1. The Commission approves for B.C. Hydro Rate Schedule 1848 RTP - Transmission Service - (5,000 kvA and over) on an interim basis, effective January 31, 1996, subject to the following conditions: (i) Any customer wishing service under Rate Schedule 1848 will apply to the Commission for permission to access the rate and for approval of the specific Electric Service Agreement applicable to service to that customer; and (ii) Any Electric Service Agreement entered into while the interim approval is in effect will contain a term permitting amendment of the agreement to comply with the requirement of any final order made by the Commission in connection with Rate Schedule 1848. 2. The Commission will approve, subject to timely filing by B.C. Hydro, Electric Tariff Pages in accordance with the approval given by this Order. 3. B.C. Hydro will provide all Rate Schedule 1821 - Transmission Service Customers with a copy of this Order and Executive Summary of the ISO Application. .../3
3 4. The Commission issues the following regulatory schedule and timetable of deadlines for the ISO Application. Action Workshop Information Requests made to B.C. Hydro by Intervenors B.C. All parties wishing to intervene in the ISO Application are requested to give notice in writing to the Commission Secretary and B.C. Hydro no later than February 12, 1996. 6. All parties intending to apply for Participant Funding must file a budget by February 12, 1996. The budget must be consistent with the Commission's Policy and Rate Sheet as outlined in Order No. G-117-93. Copies of the Participant Funding Policy and Rate Sheet are available upon request. 7. B.C. Hydro will publish, in display-ad format, the attached Notice in the business sections of The Vancouver Sun and The Province newspapers, and in local newspapers in the affected service areas as soon as can be arranged. Vancouver, B.C. THE APPLICATION On January 22, 1996 B.C. Hydro filed an application on its service to industrial customers identified as Industrial Service Options ("ISO"). The application requested that tariffs be approved on an interim basis effective January 31, 1996. The Commission approved the request and issued Order No. G-5-96 which set out a regulatory timetable and oral public hearing. PUBLIC INSPECTION OF THE ISO APPLICATION The ISO Application and supporting material are available for inspection at the following locations: British Columbia Hydro and Power Authority Head Office: 333 Dunsmuir Street, Vancouver, B.C. District Offices: All Districts Offices in its service territory Copies of the ISO Application and supporting material are also available for inspection at the office of the British Columbia Utilities Commission, 6th Floor, 900 Howe Street, Vancouver, B.C. V6Z 2N3. INTERVENTIONS Intervenors who wish copies of the ISO Application and other information are urged to register with the Commission and B.C. Hydro as soon as possible. Intervenors and interested parties are to advise the Commission Secretary of their intention to participate in the proceedings not later than February 12, 1996. INFORMATION REQUESTS Initial Information Requests sent to B.C. Hydro by March 1, 1996 shall be responded to by B.C. Hydro before March 22, 1996. .../2
2 SUBMISSIONS BY INTERVENORS Written evidence and submissions from Intervenors is required to be filed, one copy each with the Commission Secretary and B.C. Hydro, by April 4 1996. PARTICIPANT FUNDING All parties intending to apply for Participant Funding must first register with the Commission and obtain the guidelines for participant funding. All parties must then file a budget by February 12, 1996 consistent with the Commission's Rate Sheet as outlined in Order No. G-117-93.
