PELLATT BC TOLL FREE: 1-800-663-1385 COMMISSION SECRETARY FACSIMILE: (604) 660-1102 VIA FACSIMILE June 14, 1995 Mr. R. Brian Wallace Bull, Housser & Tupper Barristers & Solicitors 3000 Royal Centre, P.O. Box 11130 1055 West Georgia Street Vancouver, B.C. V6E3R3 Dear Mr. Wallace: Re: BC Gas Utility Ltd. Complaint - By-Pass Rate-FMC Corporation This will acknowledge receipt of your April 28, 1995 letter complaining to the Commission, on behalf of your client, FMC of Canada Limited, with regard to FMC's by-pass rate and requesting the Commission appoint an independent Inquiry Officer. It is the Commission's view that the appointment of an Inquiry Officer at this stage of a complaint would not be appropriate. Prior to deciding whether or not to appoint an Inquiry Officer, the Commission requires both parties to identify and present their positions, in writing, in anticipation that the complaint can be resolved. Accordingly, and by copy of this letter to yourself and BC Gas, we require that FMC and BC Gas present written submissions and any supporting documentation to the Commission by June 30, 1995. Yours truly, RJP/mrnc cc: Mr. D.M. Masuhara, Vice President Legal and Regulatory Affairs Be Gas Utility Ltd. BCG/Cor/By-Pass Rate-Compl.FMC
