BEFORE: M.K. Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) June 26, 1996 O R D E R WHEREAS: A. On April 4, 1996 the Commission approved, on an interim basis effective April 1, 1996, the British Columbia Hydro and Power Authority ("B.C.ÊHydro") Application for approval of the FebruaryÊ23, 1996 Agreement with Howe Sound Pulp and Paper Limited ("HSP") for access to the RTP option, with a 100Êpercent CBL as provided for under Rate Schedule 1848 that resulted in an initial CBL for HSP between 50 MV.A and 60 MV.A; and B. On June 19, 1996 B.C.ÊHydro advised the Commission that HSP shut down its electricity generators and consumed B.C.ÊHydro supplied electricity from February 23 to March 31, 1996 under incorrect advice from B.C. Hydro that this energy would be billed under Rate Schedule 1848 rates; and C. The Application made by B.C.ÊHydro requested that the Commission approve the forgiveness of the difference in the rate schedules for the incremental electricity that occurred in February and March 1996, pursuant to SectionÊ69 of the Utilities Commission Act ("the Act"); and D. In a letter, HSP confirmed to the Commission that purchases made under Rate Schedule 1848 were taken according to the terms and conditions of its February 23, 1996 CBL Agreement with B.C.ÊHydro; and E. The Commission has reviewed the Application and finds that approval is necessary and in the public interest. NOW THEREFORE the Commission approves for B.C.ÊHydro, pursuant to Section 69 of the Act, the forgiveness of the difference between the billing of energy under Rate Schedule 1821 compared to the CBL Agreement and Rate Schedule 1848 for the period February 23, 1996 to March 31, 1996 with respect to HSP.
